1903 CLAIMS COMPENSATION PROTECTED BURGHER PIET RETIEF AND WAKKERSTROOM. JACOB LOUIS VOLKENBERG NEL, JACOB LOUIS POCKLEBERG NEL CJC 250

Surrendered Sandbank 19th Feb 1901and arrived at Volksrust camp 16 March 1901 where he remained for a year. In March 1902 joined the Intelligence Corps and remained with them till the end of the war. Took the oath of Allegiance at Volksrust 16 August 1902.  His wife’s name is given as Maria Isabella Cecilia; address Derby Piet Retief; she was a witness to goods claimed in 1903. There were then 2 minor children.

Remarks of commission: the claimant surrendered due to ‘wounds’ but ARM noted this was ‘not correct’. The claimant was deserving of consideration, but no payment was to be made until his claims and those of his father’s, whose receipts seemed to have become confused, were carefully investigated.

He surrendered Piet Retief town 1st March 1901 and was sent to Volksrust, where he remained until 26 November 1901. Joined the Looting Corps and remained with them until 14 Feb 1902. He then became a Guide. Unmarried and lived with his father at Kromrivier; and when his father left for Natal he lived with Piet Uys. His livestock was claimed together with his father’s and for which he had received £54 from his father. This required close investigation since the claimant was still on commando when his father obtained the receipt for their combined livestock.  (Anita Campbell)

At the time of her death Anna Maria had effectively disposed of, or allocated, all the immoveable assets. She was survived by her grandchildren (children of Christina Helena van Rooyen) and great-grandsons by Petrus Hendrik van Rooyen.

Petrus Hendrik van Rooyen of Escourt. He is given 300 acres of the farm Buffelshoek or Mormond, district Weenen.

Philip Petrus Lotter van Rooyen received the subdivision of farm Doornkloof named Doornkloof. He was married to Jacoba Elizabeth de Villiers and they had 3 daughters. Both are buried at Doornkloof. Their daughter. Hester Petronella was married to Jacobus Kruger Rautenbach who died10 March 1955 and is buried at Doornkloof.

Roelof Johannes Jurgen van Rooyen received the farm portion of Doornkloof now known as Morgenson. He was also given about 142 acres of the farm Scottspoort as well as 560 acres of the farm Buffelshoek (or Mormond) that lies adjacent to Scottspoort

Christina Helena de Wet of Vryheid to receive £800.

In a further codicil dated 8th July 1927, she stated that she has sold Cyferfontein and that the two great grandchildren Roelof Johannes Jurgens van Rooyen and Johannes Stephanus Boshof van Rooyen should therefore receive £800 shared between them.

She bequeaths a sum of £800 to be paid to Christina Helena Stadler (born Lotter) d.1933 married to Johann Hendrik Stadler of Rietfontein, Machadodorp (a niece – godchild?).

Piet Retief on 19th February 1901, arrived Volksrust on the 19th March and remained there for 10 months when he was given leave to go to Natal and where he remained until the end of the war.  His sons all served with the Piet Retief commando. Philip Jacobus Nel and Jacob Louis Poklenberg Nel surrendered together with him. Stephanus Christiaan Nel and Willem Martinus Johannes Nel surrendered 1 March 1901. The family lived together at Volksrust until his sons joined the National Scouts. Upon claims amounting to £460 he had received £193, the rest of the claim having been referred to the ARM Piet Retief. The commission decided that he deserved special consideration as he was old and infirm, the farm he owned was heavily mortgaged and his sons had all rendered service. He was unlucky in receiving no receipt for his sheep (£1403 claimed) or bales of wool (£100) but recommended an additional £100 to repair his home (his claim for this was £897). He lists his address as Kromrivier, Piet Retief (Anita Campbell)

Johanna Petronella Lotter died 14 Jan 1924 at the house of her son-in-law Izak Johannes de Jager Vaalbank 94 district Ermelo. She went to live with them from June 1921. A charge for board and lodging at £3/month till July 1923 and then at £6/month to cover the additional costs of daily nursing, totalling £108 was lodged against her estate by son-in-law I Z de Jager. He and his brother were married on the same day to two Lotter sisters.

Information about Stephanus can only be gleaned from the 1903 Compensation claims made by his brother J P Nell and his son Jacob Lowies Poklenberg Nell.

The family had become ZAR residents in 1885 – this would be following the death of his mother and we may deduce that although J P Nell had already made the move from Utrecht in 1881, Stephanus and his family remained on the farm Welgevonden, Utrecht until then.
 
The following observation is purely subjective: something happened at the time of the birth of their ninth child that made the couple decide that there would be no more children. There is no mention of their daughter Elizabetha Louretta surviving and her twin brother Stephanus may also have been a bit delicate. Likewise, no mention of daughter Anna Maria Nell surviving. Stephanus Nell, called upon as a witness to his brother’s compensation claim, signs his name in a very spidery manner – could he have suffered from a stroke, Parkinsons etc.?

Unlike his brother JP Nell who seems to have established a flourishing farming enterprise, there is no indication that Stephanus and his family were anything more than bywoner farmers and at the time that the war broke out, they lived on the farm Edinburg of his son-in-law Barend Roos. (Anita Campbell) It had been reported in January 1901 that burgers from Piet Retief had moved with most of their stock further east into the Mkwakweni hills north of the Phongolo River. They were very impoverished with no proper clothing, only meat and mealies but no salt, and the women and children in particular were suffering. French's objective was to advance to a line from Piet Retief northwards through Amsterdam and force the commandos in the area either to surrender or to move into Swaziland.

Stephanus and his family surrendered voluntarily at Sandbank dist. Piet Retief on 19th February 1901 together with his brother J P Nell, arrived at Volksrust camp on the 19th March and remained there for 10 months when leave was given to go to Natal and where they remained until the end of the war. In Jacob Lowies Poklenberg Nell’s claim he states that they went to Scottspoort i.e the farm of his widowed aunt Anna Maria Lotter.

Three of Stephanus’s sons however did not surrender with the family. Their brother-in-law Barend Roos was not only in effect their landlord, but also the veld kornet for the district. These three brothers were captured on 9/6/1901 at the farm Weeber and sent to Bermuda.

Stephanus and his family must have remained at Scottspoort, Natal until the middle of 1902, since the POWs had to ship back home. They had little to go back to in Transvaal – this area of the Eastern Transvaal really suffered with Kitchener’s scorched earth policy. Barend Roos returned to his family farm in Pretoria circa 1910, selling Edinburg to Strydom (record: Jan Adriaan STRYDOM *11.6.1906 (Okahandja) † 12.5.1915 Edenburg, Piet Retief). His brother J P Nell died in 1910. His sister Maria Pieterse of Vlakfontein died 1907 and her husband in 1914; the marriage certificate of Jacob Lowies Poklenberg Nell in 1909 shows that he was then resident at Vlakfontein. The options for this family must have been quite limited by then.

We know that this family were definitely in Natal by 1918; J P Nell and his brother P J Nell were witnesses at the marriage of their niece Martha Louisa Lotter Roos in Greytown. . I surmise that Anna Maria Lotter, Stephanus’s sister, may very well have assisted monetarily in some way. Stephanus would have known this area well, having been raised on Bird Spruit.
 
J P Nell married in 1922 at Schottsfontein. This farm is given as his address as late as 1950 in Braby’s Natal Directory, but he lived at Kafferspoort from mid-1920’s and his mother and father both died on this farm. In mid-1920’s his brothers JLP Nell and PJ Nell farmed in Klip River county. Braby’s Natal Directory 1950, lists the following (note NEL as surname):

His wife Martha Louisa wrote a letter dated 21st December and submitted a will.  Though the writing is very faintly written in pencil, this will was rejected because it was written partly on white paper and partly on blue paper and parts were deemed illegible.

Although the second youngest son, Johannes Petrus Nell was elected as the Executor Dative.

I have no information as to the original farm/s occupied by this Nel family, but the birth of Susanna Johanna Maria in 1846 (per death certificate) is Ladysmith, Kliprivier county and this family are living on the farm Birdspruit in the Weenen county by 1859.  She is the first family member to sign her surname as NELL on an official document.  Her brothers starting using the NELL surname after their father’s death in 1876. (Anita Campbell)
